These terms apply to the Hungry Jake’s brand, website, and all locations that operate under the Hungry Jake’s name. Hungry Jake’s is a concept created and owned by O.H.N. Creations B.V..

1. WHO WE ARE

The Hungry Jake’s brand, logo, menu concepts, and website are owned by O.H.N. Creations B.V.. Individual kitchens and locations may be operated by O.H.N. Creations B.V. or by independent operators / franchisees under a franchise or licence agreement.

Hungry Jake’s is primarily a delivery-focused dark kitchen concept. It can also operate as a brick-and-mortar location where that has been agreed with the local operator.

2. LOCATIONS & OPERATING LIABILITY

Each physical location is operated by the business entity registered at that address. Liability for food preparation, hygiene, orders, delivery (where applicable), and customer service at a specific location rests with the operator of that address — not with other locations or with the brand owner, unless a location is directly operated by O.H.N. Creations B.V..

Operating liability (food safety, order fulfilment, local complaints, and any local employment or permits) sits with the operator of the specific location. O.H.N. Creations B.V. is the brand and concept owner and is not automatically liable for the day-to-day operations of independently operated kitchens.

3. FRANCHISE & LICENCE AGREEMENTS

Where a location is operated by a third party, that operator has entered into a franchise, licence, or similar agreement with O.H.N. Creations B.V. (or its authorised representative). Those contracts govern the use of the Hungry Jake’s brand, menu standards, and operational requirements.

Franchise / licence agreements are confidential between the parties. They do not create a direct contractual relationship between the end customer and the brand owner for the fulfilment of individual food orders, unless explicitly stated.

4. ORDERS & DELIVERY

• Orders are typically placed via third-party platforms (e.g. Thuisbezorgd) or directly where available.
• Delivery times, fees, and availability are determined by the platform and the local kitchen.
• Once an order is accepted by a location, the contract for that order is between you and the operator of that location.
• Prices shown include applicable VAT unless stated otherwise.

5. FOOD SAFETY & ALLERGENS

All food is prepared in commercial kitchens that must comply with Dutch food safety regulations. Allergen information is available on request at the location or via the order platform. If you have a severe allergy, contact the kitchen before ordering.

6. CANCELLATIONS & REFUNDS

Cancellation and refund rules follow the policies of the platform used to place the order (e.g. Thuisbezorgd) and the local operator. Contact the location or the platform for order-specific issues.

7. INTELLECTUAL PROPERTY

The Hungry Jake’s name, logo, pixel artwork, menu concepts, and website content are owned by O.H.N. Creations B.V. or its licensors. You may not copy or use them without written permission.

8. LIABILITY

To the maximum extent permitted by Dutch law:

• O.H.N. Creations B.V. is not liable for the acts or omissions of independent location operators.
• Each location operator is responsible for its own food, hygiene, staff, and customer orders.
• Nothing in these terms limits liability for death, personal injury, or fraud where such limitation is not permitted by law.

9. PRIVACY

Personal data is processed in accordance with the GDPR (AVG). Read our full privacy statement. When you order via a third-party platform, that platform’s privacy policy also applies. Contact us for questions about data held by a specific location.

10. GOVERNING LAW

These terms are governed by the laws of the Netherlands. Disputes relating to a specific order should first be directed to the operator of the location that prepared the order.
